What does legal due diligence cover before buying property in Bulgaria?
Pre-purchase due diligence verifies: the seller's title and chain of ownership in the Property Register, encumbrances (mortgages, easements, claims), planning status and building permits, whether the property is subject to restitution claims, and any outstanding taxes or utility debts. Skipping due diligence is the most common cause of disputes in Bulgarian real estate transactions.
Can non-EU foreigners buy real estate in Bulgaria?
Non-EU nationals cannot directly purchase land (agricultural, forest or regulated plots) in Bulgaria — they must use a Bulgarian company. Apartments and buildings can be purchased directly. EU citizens and their companies may buy all types of property. These rules do not restrict the right to purchase property in a building (apartment, office, shop).
What is the difference between a preliminary and a final contract when buying property?
The preliminary contract sets out the terms of the transaction and is concluded before the notarial deed — usually with payment of a deposit. If the seller fails to perform, the buyer may seek a court order declaring the contract final. The final contract is executed before a notary and transfers ownership.
