When should I hire a lawyer for a civil dispute in Bulgaria?
Engaging a lawyer is advisable before a dispute escalates to litigation. A lawyer can assess whether the claim is viable, calculate limitation periods (typically 5 years for general civil claims, 3 years for tortious claims), draft demand letters, and attempt pre-court settlement. Once proceedings start, representation becomes essential for procedural compliance and evidence management.
How does debt collection work through Bulgarian courts?
For undisputed debts, the creditor applies for a payment order (заповед за изпълнение) — a fast-track procedure under Art. 410 CPC. If not opposed within 2 weeks, the order becomes an enforcement title. For disputed claims, a full civil action is required. Once a court judgment is obtained, enforcement is handled by a private enforcement agent (ЧСИ) who can seize bank accounts, wages and property.
How is an administrative act appealed?
Administrative acts are appealed to the superior authority within 14 days, and if upheld, before the administrative court within 14 days of receiving the decision. The administrative court's ruling is subject to cassation appeal before the Supreme Administrative Court.
