Intellectual Property

Registration and protection of trademarks, copyright and industrial design in Bulgaria and the EU.

Intellectual property is one of the most valuable assets of any modern business. Global Lex Consulting provides legal assistance in the registration, protection and enforcement of all types of intellectual property rights.

Our lawyers advise clients on choosing the appropriate protection mechanism, conduct searches for identical or similar marks and designs, and prepare the required documents for registration before the Patent Office of the Republic of Bulgaria and the European Union Intellectual Property Office (EUIPO).

In cases of intellectual property infringement, we provide legal protection — cease-and-desist letters, negotiations, interim measures and procedural representation before civil and administrative courts.

Frequently Asked Questions

How do you register a trademark in Bulgaria and the EU?
A Bulgarian trademark is registered with the Patent Office (BIPO) and provides protection only in Bulgaria. An EU trademark (EUTM) is registered with the EUIPO in Alicante and covers all 27 EU member states with a single application. Both require a clearance search, specification of goods/services by Nice class, and examination for absolute and relative grounds. Registration typically takes 6–12 months if unopposed.
What legal protection is available against copyright infringement in Bulgaria?
Copyright in Bulgaria arises automatically upon creation — no registration is required. Infringement can be addressed through civil claims (injunction, damages, account of profits) before district courts, border measures (customs seizure of infringing goods), or criminal prosecution for large-scale piracy. The 3-year limitation period runs from the date the rights holder became aware of the infringement.
