- How is an estate divided under Bulgarian inheritance law?
- Bulgarian inheritance law follows a statutory order of succession. Descendants (children, grandchildren) inherit first, followed by parents and siblings, and then more distant relatives. A surviving spouse inherits concurrently with descendants. Intestate shares are equal among members of the same degree. Testamentary inheritance is permitted, but the law reserves a mandatory share (запазена част) for descendants and surviving spouses which cannot be reduced by will.
- Can a foreign national inherit real estate in Bulgaria?
- Yes — foreign nationals may inherit Bulgarian real estate regardless of nationality. However, non-EU nationals who inherit agricultural land or forest may not retain ownership and must transfer the property to an eligible person or a Bulgarian company within 3 years of acquisition. This restriction does not apply to buildings or apartments, which foreign nationals may own directly.
