- What rights does EU law grant to third-country nationals legally residing in Bulgaria?
- Third-country nationals lawfully resident in the EU benefit from free movement within the Schengen Area, conditional access to the labour market, and protection against discrimination under the Equal Treatment Directive. Holders of EU long-term resident status (Directive 2003/109) gain additional rights to move and reside in other EU member states for work or study purposes.
- When does EU law take precedence over Bulgarian national legislation?
- EU law has primacy over national law in cases of conflict. EU Regulations apply directly and do not require national transposition. Directives are binding as to the result but require national implementing legislation. Where a Directive's transposition deadline has passed and a member state has failed to implement it, individuals can invoke the Directive directly against state bodies (vertical direct effect).
