- Does a detained person have the right to a lawyer in Bulgaria?
- Yes. Under Art. 6 ECHR and the Bulgarian Code of Criminal Procedure (CPC), any person detained by police or charged with a criminal offence has the right to defence counsel from the moment of detention or first interrogation. The authorities must inform the detained person of this right immediately and must not conduct interrogation until the suspect has had a reasonable opportunity to consult a lawyer.
- What does the pre-trial phase of criminal proceedings involve in Bulgaria?
- The pre-trial phase is conducted by the prosecution and is not open to the public. It includes: initial investigation, gathering of evidence, interrogation of suspects and witnesses, forensic expert opinions, and any custodial measures (detention, house arrest, bail). The phase ends when the prosecutor decides whether to bring charges (indictment) or to discontinue. Defence counsel has the right to access the investigation file and submit evidence.
