Under what conditions is a contract void under Bulgarian law?
Under Art. 26 of the Obligations and Contracts Act, a contract is void (нищожен) when it: contradicts the law or good morals, has an impossible subject matter, is made without genuine consent, or is aimed at circumventing mandatory law. Void contracts produce no legal effects and either party may rely on nullity at any time — there is no limitation period for nullity claims.
What compensation can you claim for breach of contract in Bulgaria?
Under Art. 82 OCA, the non-breaching party may claim direct and immediate losses and lost profits caused by the breach. If a penalty clause (неустойка) was agreed, it is due regardless of whether actual damage is proven, unless the court reduces it as grossly excessive. Statutory interest for late payment accrues from the date the debtor is formally put in default (покана).
