Bulgarian law allows foreign nationals who are family members of a Bulgarian citizen to obtain the right of extended residence in the country. This ground is among the most commonly used by spouses, children and other close relatives of Bulgarian citizens who wish to live lawfully in Bulgaria and to benefit from the rights granted to resident foreign nationals.
This article examines who may apply for extended residence as a family member of a Bulgarian citizen, what documents are required, how the procedure unfolds, and what rights the resulting status confers.
When it applies
This ground covers two common scenarios:
- a foreign national who has entered into civil marriage with a Bulgarian citizen;
- a foreign national who is a parent of a child with Bulgarian citizenship, including where no marriage has been concluded with the other parent.
Why it is facilitated
The type D visa for a family member of a Bulgarian citizen is reviewed within 14 days and no state fee is due. In addition to the standard document package required when applying for a long-stay visa, duly legalised and translated documents proving the family link between the applicant and the Bulgarian citizen must also be submitted.
The procedure
The foreign national files an application for a type D visa at a Bulgarian diplomatic mission abroad, submitting documents that prove their family link with the Bulgarian citizen. After arrival in Bulgaria, an application for an extended residence permit is filed with the Migration Directorate. The permit is issued for a period of one year with the possibility of annual renewal.
Documents required
In addition to the passport and the standard supporting documents (criminal record certificate, health insurance, proof of accommodation and means of subsistence), the procedure requires a marriage certificate or a birth certificate for the child — duly legalised and translated.
